Before January 22, 2024, every international student could come to Canada with their spouse and children (except if you are in a non PGWP school)

However, all this changed on January 22, 2024 when the Canada government announced that only the spouses of Masters and PHD students would be eligible for the Spousal Open Work Permit.

Considering the new Canada study policy on January 22 2024, restricting spouses of applicants who are studying a diploma, PGD/PGC or BSC from getting a Spousal Open Work Permit, a lot of people have asked “what is the fate of my husband/wife and children?”

Below are my answers:

âž¡ Any parent applying to study in Canada is welcome to include their dependent children on their study visa application. However, only children below 18 years can study for free in elementary and high school. They cannot work!

âž¡ A child under 22, or over 22 but dependent on parents because of a mental or physical condition can also be added.

âž¡ The children are issued a visa authorizing their stay in Canada for the same duration as the parent’s visa.

âž¡ Once inside Canada, all children 18 years and younger are allowed to study at Canadian elementary and secondary schools.

âž¡ Most Canadian schools for children are public and free! Canada is a global leader in quality of education, so children will be receiving the high-quality learning they deserve.

âž¡ Concerning your spouse, he/she will not be eligible for a Spousal Open Work Permit SOWP except you are studying for a Masters or Phd in Canada.Your spouse can still visit you in Canada. It is possible that during this visit period, such spouse can get an LMIA job which will qualify him/her for a work permit.

âž¡ If you are concerned about including your family members on your study visa application, I understand. However no one can change this policy for now so I advise you to just work around it.
